By accessing or using the MediConsult mobile application or web platform (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

The Service is intended for users who are at least 18 years old. If you are using the Service on behalf of a healthcare institution, you represent that you have the authority to bind that entity.

2. Description of the Service

MediConsult provides AI‑assisted tools to support medical consultations. The core functionality includes symptom analysis, clinical summarisation, and secure communication between patients and healthcare professionals.

3. User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information.

• Patients: You confirm that the medical information you share is accurate to the best of your knowledge.
• Healthcare professionals: You are solely responsible for the final clinical decisions and for complying with all applicable laws and ethical obligations.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to impersonate any person.
• Attempt to reverse engineer, scrape, or disrupt the AI models or infrastructure.
• Share another person's protected health information without authorisation.
• Use the Service to provide independent medical advice without proper credentials (if you are not a licensed professional).

5. Intellectual Property

All content, algorithms, software, and trademarks comprising MediConsult are owned by MediConsult AI Health, S.L. or its licensors. You are granted a limited, non‑exclusive, revocable license to use the Service for its intended purpose.

You retain ownership of any data you submit (as described in our Privacy Policy), but you grant us a license to process it solely to provide and improve the Service.

6. Fees and Subscriptions

Some parts of MediConsult may be offered free of charge; others may require a subscription or one‑time payment. Fees, if applicable, will be clearly disclosed before you incur them. All payments are non‑refundable except as required by law or explicitly stated.

7. Third‑Party Services

The Service may contain links to external websites or integrate with third‑party tools (e.g., electronic health records). We are not responsible for the content or practices of those third parties.

8. Limitation of Liability

To the fullest extent permitted by law, in no event shall MediConsult AI Health, S.L. be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any conduct or content of any third party; (iii) unauthorised access to or alteration of your data.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us (if any) during the twelve months preceding the event.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR THAT ANY AI OUTPUT IS ACCURATE OR RELIABLE.

NO INFORMATION OBTAINED BY YOU FROM MEDICONSULT SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

10. Indemnification

You agree to defend, indemnify, and hold harmless MediConsult AI Health, S.L., its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, effective immediately. You may terminate your account at any time via the app settings. Sections 5, 8, 9, 10, and 12 shall survive termination.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Spain, without regard to its conflict of laws principles. Any dispute arising out of these Terms shall be resolved exclusively in the courts of Madrid, Spain. However, we may seek injunctive relief in any jurisdiction to protect our intellectual property.

For users in the United States: This provision does not limit your right to file a complaint with the Federal Trade Commission or other agencies.

13. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you via email or in‑app notification. Your continued use after the effective date constitutes acceptance of the revised Terms.
